The Chamber of Mechanical Engineers, arguing that the reason for the amendment in the Public Procurement Law is not in the public interest, stated that it is against the principle of impartiality that AKSA, which is a contractor, is in the same commission with the Central Tender Commission and Competition Board and that legal amendments are made for procurement.
Chairman of the Chamber of Mechanical Engineers, Ayer Yarkıner, made a written statement regarding the amendment in the Public Procurement Law.
In his written statement, Ayer Yarkıner criticizes the reasoning presented by the Minister of Public Works and Transport Erhan Arıklı for the amendment of the Public Procurement Law and said, "Those who propose this legal amendment will have financial, legal and conscientious responsibilities for material damages that cause/will cause harm to the country."
In the statement referring to the news that 4 power plants failed yesterday, it was claimed that it was "not normal" for these power plants to fail in such a short time, although it was stated that the maintenance and repair would be made in the decisions of the Council of Ministers, and although payments were made for the maintenance supply in the supply costs of the generators.
“It is the determination of the extent to which the installed power of Kıb-Tek is ready for service, the amount of maintenance and repair needed, and the urgent need for installation, if any, and procuring it with a competitive tender. It is one of the issues to be investigated. Despite the decommissioning of GT power plants, Kıb-Tek was sufficient to meet the need with 45 percent of its installed capacity.
In 2009, the total energy need was 1,190,068 mw (Kıb-Tek installed power capacity was 2,277,600 mw). While Kıb-Tek's own installed power was able to meet this need, there was no need for a 15-year agreement with AKSA. In this period, it is questionable to make a contract with AKSA instead of making plans to ensure that the installed power is available, smart grid installation, solar system and storage systems. The installation price and the fuel price in this contract were not in line with the current and technical values.”
In the evaluation, it was argued that 71 percent of the installed power was sufficient for the production of the energy needed in 2018, and there was no weakness when the need and the installed power capacity were compared, although there were claims of capacity insufficiency between the years 2000-2018.

The cost of repairing the generator, which has been defective for more than three years, was negotiated by the insurance and offered to pay 1/5 of the repair price. Again, in this period, unsuitable fuel supply continued and damage to the generators continued, and tenders on 'periodic maintenance' were held without sharing the reason for the damage and the need for repair with the public. The contract value of these tenders was 4 million Euros, and it was tried to be settled with a non-tender method. KTMMOB Chamber of Mechanical Engineers brought the issue to the judiciary. Subsequently, these maintenances were carried out without tender with the decrees prepared. In the payment terms prepared, "payment without maintenance" is written in favor of the contractor. The cost of the energy not produced by the power plant, which has not been repaired by insurance for more than 3 years, is 9 million USD. The supply of this unproduced energy from AKSA is 26 million USD.”
The evaluation said, “Kıb-Tek or its union is not responsible for this, it is the Board of Directors and the ministry they are affiliated with. For the past period, Mr. Erhan Arıklı.
