Appeal of Citizenship Rejection for Child of Mixed Marriage Denied

The appeal against the rejection of citizenship for a child born from a "mixed marriage" has been dismissed by the court. The appeal was rejected on Thursday by the South Nicosia Administrative Court.

The court upheld a Council of Ministers decision from the era of the late President Tassos Papadopoulos in 2007, which stipulated that children born from mixed marriages, where one parent is a Turkish citizen who entered and resides in the north after 1974, cannot be citizens of the Republic of Cyprus.

The applicant was born in 1995 in the Girne region, in the village of Mandria, under the administration of the Baf region, to a mother from Cyprus and a father from Turkey.

In January 2019, the applicant applied for Cypriot citizenship through legal representation, but the Immigration Department rejected the application in October of the same year.

The Immigration Department stated that the applicant's application could not be approved due to laws that do not allow the registration of a person as a Cypriot citizen if their parents' entry to Cyprus or residence in Cyprus is illegitimate.

The court also noted that both the applicant and the father hold citizenship of the Republic of Turkey, thereby affirming the decision of the Immigration Department.
