Journalists’ Union Rejects Law, Calls It Interference Under “Presumption Of Innocence”
The Turkish Cypriot Journalists Union (KTGB) has strongly criticised amendments to the Criminal Procedure Law, describing the changes as a direct intervention in freedom of expression and the public’s right to information.
In a statement, the union said the regulation, justified on the grounds of the “presumption of innocence,” directly targets the free press and exposes journalists to criminal sanctions despite widespread objections from professional organisations.
The KTGB stressed that, according to European Court of Human Rights case law, reporting on judicial processes in cases of public interest—particularly involving well-known figures—falls within the scope of freedom of expression.
The statement argued that under the new regulation, journalists face the threat of imprisonment and fines simply for carrying out their duties, adding that criminalising the use of names and photographs does not protect the presumption of innocence but rather constitutes an abuse of the principle.
The union said the measure risks restricting public access to information and undermining social oversight, particularly at a time when allegations of corruption and misconduct are on the agenda.
“The aim is to reduce the visibility of the truth and leave the public in the dark,” the statement said, adding that the core functions of journalism—scrutiny and informing the public—are being placed under pressure.
Declaring the amendment unconstitutional and contrary to universal legal principles, the KTGB said it does not recognise the regulation and called on its members not to refrain from using names and photographs in reporting, particularly in cases involving public figures.
“Journalism is not a crime; the public’s right to information cannot be restricted under any circumstances,” the statement said, adding that the union will continue to oppose any measures targeting press freedom through legal and democratic means.
