Foreign Ministry: Council Of Europe Decision Not Related To TMK Effectiveness
The Ministry of Foreign Affairs has said that a recent decision by the Council of Europe’s Committee of Ministers does not question the effectiveness of the Immovable Property Commission (TMK), stressing that its status as an effective domestic remedy has been repeatedly confirmed by the European Court of Human Rights.
In a written statement on the Committee’s 9–11 June 2026 meeting in Strasbourg, the ministry said the issue concerns the supervision of the execution of a 2001 European Court of Human Rights ruling on property rights and was discussed under that framework.
It said the Council of Europe Secretariat, which oversees the execution of ECHR judgments, has previously concluded that the obligations in question have been fulfilled and that supervision could be closed, but that political objections by the Greek Cypriot side have prevented this.
According to the statement, the Committee of Ministers has now tasked the Secretariat with preparing a draft study on the interpretation of certain property-related wording in a 2014 ECHR judgment, with a procedural decision to review that draft at a later stage.
The ministry accused the Greek Cypriot side of politicising a legal and technical process and using its EU presidency to influence discussions within the Committee.
It said the latest decision has “absolutely no relation” to the effectiveness of the TMK, adding that only the European Court of Human Rights has the authority to rule on its legal status.
The statement further noted that the ECHR has repeatedly recognised the TMK as an effective domestic remedy, including in its most recent ruling in June 2025.
The ministry added that Turkish Cypriot authorities will continue to support the functioning of the TMK as a guarantee of the property regime in Northern Cyprus.
